This introductory list will help you communicate effectively with your lawyer.
Litigation: The act of bringing a case to court to settle a dispute.
Plaintiff: The party or group of parties bringing the lawsuit (this is probably you).
Defendant: The party allegedly liable for the plaintiff’s injuries (this is the guy who hurt you).
Negligence: Failure to exercise the care of a reasonably prudent person in similar circumstances.
Damages: Money a plaintiff is seeking to recover in a lawsuit to cover bills and pain and suffering.
PIP: Stands for personal insurance protection which extends car insurance to cover medical expenses and lost wages.
Contingency Fee: A percentage of the damages paid to the lawyer only if the case is won.
Complaint: First document filed with a court by a person or entity claiming legal rights against another.
Statute of Limitations: The time allowed to pass between the event causing injury and the filing of a complaint.
Answer: Defendants file a formal answer to the complaint to notify the plaintiff and the court of the defendant’s position.
Affidavit: A written statement confirmed by oath or affirmation, for use as evidence in court.
Deposition: Involves a witness being asked questions about the case.
Discovery: Pre-trial procedure for each party to obtain evidence from the other party.
Power of Attorney: The authority to act for another person in specified matters.
Prayer for Relief: A portion of the complaint in which the plaintiff describes the remedies that the plaintiff seeks from the court.
Tort: A civil wrong that unfairly causes someone else to suffer loss or harm resulting in legal liability for the person who commits the tortious act, called a tortfeasor.
