Gina Miller Brexit Case Dismissed! In some very good news, the case brought in the High Court in London by Gina Miller to try and stop Parliament being prorogued has been dismissed.

Gina Miller brought this case trying to argue that the action taken by Boris Johnson to prorogue or shut down parliament for five weeks in the run up to Brexit was 'an unlawful abuse of power'.

However the learned judges begged to differ and decided that the case should be dismissed.

They have though given Gina Miller the opportunity to appeal the case and that is due to be heard on the 17th of September.

Don't these anti-Brexit cases move fast through our courts?

Anyway, Gina Miller said she was 'very disappointed with the judgment'.

Oh dear, how sad, never mind!

And she also said:

"We feel it is absolutely vital that Parliament should be sitting. We are therefore pleased that the judges have given us permission to appeal to the Supreme Court, which we will be doing, and they feel that our case has the merit to be handed up."

But in rejecting the case Lord Chief Justice Burnett said:

"We have concluded that, whilst we should grant permission to apply for judicial review, the claim must be dismissed."

That's two cases against prorogation that failed so far this week.

It's just a pity that they are wasting time and money (hopefully their own) because the house of Lords is pushing through a bill designed to stop a no deal Brexit before prorogation. And if the Lords are successful then the government was right to say that MPs and Lords had sufficient time to debate and act on Brexit, wasn't he?

Pretty much negates the whole crux of Miller's arguments, doesn't it?

And a bit of news on the progress of the surrender bill through the House of Lords.

Tory Peer, Lord True, has forced the Lords to vote on an amendment to the surrender bill.

His amendment calls for a General Election to take place prior to the resulting Act coming into force.

Now, he knows his amendment will be voted down. But it is forcing the Lords to each put their name down publicly as they march through the Not Content Lobby so signifying their contempt for the will of the people to be sought before further extending Article 50.

During the debate the Lords used all sorts of excuses to vote against it, but at the end of the day they could have signified their approval by letting it go through and then let the MPs in the House of Commons reject it, couldn't they?

But they didn't - it seems that they dislike the whiff of democracy. They voted it down by 283 votes to 28. I do hope a full list of names will be quickly forthcoming.

Good try by Lord True though.
